In what has been viewed by many as ‘awful ruling’, a federal judge in Texas has ruled that the Affordable Care Act (ACA) which is commonly known as Obamacare was unconstitutional based on its mandate which require people to buy health insurance. According to District Judge Reed O’Connor, a change in tax law last year which eliminates a penalty for not having health insurance automatically invalidated the entire Obamacare law. However, this decision is expected to be appealed in the 5th U.S. Circuit Court of Appeals.
Critics argue that President Donald Trump is using the judiciary to his favor because his inability to repeal and replace Obamacare is viewed as a big defeat for him. Trump has repeatedly tried but failed to repeal Obamacare. While hailing the ruling, Trump wrote on Twitter: “Now Congress must pass a STRONG law that provides GREAT healthcare and protects pre-existing conditions.”
