Indian woman wins divorce over lack of toilet

Divorce is only granted in India if there is proof of cruelty, violence or undue financial demands. An estimated 70 percent of Indian households do not have toilets. According to UNICEF, nearly half of India’s population which is almost 600 million people defecate in the open. The so-called open defecation is one of the major health problems in India.

The family court in the northwestern state of Rajasthan ruled in favour of the woman, who argued that her husband refused to provide an indoor toilet during their five years of marriage and that it amounted to cruelty. Justice Rajendra Kumar Sharma shared the same view with her, adding that it was disgraceful for women to endure physical pain by waiting until darkness to relieve themselves outdoors.
