Obama excoriated the Justice Department’s decision

During a private call with the Obama Alumni Association, former President Barack Obama condemned the Justice Department over its decision to drop its case against former national security adviser Michael Flynn. According to Obama: “There is no precedent that anybody can find for someone who has been charged with perjury just getting off scot-free. …the “rule of law is at risk.”

In December 2017, the former national security adviser pleaded guilty in lying to the FBI as part of the Russia probe. Flynn’s defense team called for a judge to dismiss the case after alleging prosecutorial misconduct. The said case against Flynn was dropped by the Justice Department despite the fact that Flynn pleaded guilty to the crime.

Fact is Flynn was charged with false statements to the FBI, not perjury. It would be perjury if he lied in court. The case was dropped on the ground that FBI agents did not have a justifiable reason to question the then-national security adviser about his conversations with Russian Ambassador Sergei Kislyak.
